Bitcoin Retreats as SEC Postpones ETF Decisions Following Grayscale Court Win

Bitcoin‘s $26,068 rally reversed sharply within a day, erasing gains driven by Grayscale Investments’ successful legal battle against the US Securities and Exchange Commission (SEC).
Just as the crypto community celebrated Bitcoin reaching a two-week high on August 29—following a judge’s criticism of the SEC’s “arbitrary and capricious” rejection of Grayscale’s spot Bitcoin ETF application—a sudden development altered the market landscape.
The SEC’s recent decision to delay rulings on seven pending spot Bitcoin ETF applications has dampened sentiment in the crypto sector, causing Bitcoin’s price to drop approximately 5% over 24 hours.
Market data from Cointelegraph Markets Pro shows a subdued picture, with Bitcoin trading around $26,000, significantly below the $27,300 level it held following Grayscale’s legal victory.
Major investment firms including BlackRock, WisdomTree, VanEck, Bitwise, Valkyrie, Fidelity, and an Invesco-Galaxy joint venture were poised to enter the ETF market. However, their plans were abruptly paused on August 31 due to the SEC’s unexpected delay, leaving investors uncertain.
While experienced market observers, such as Bloomberg ETF analysts Eric Balchunas and James Seyffart, had anticipated these delays, the impact on Bitcoin’s price was more pronounced than expected.
The SEC’s decision grants an additional 45 days to approve, deny, or further postpone these applications. Market attention is now focused on the upcoming decision dates scheduled between October 16 and 19. However, the SEC retains the authority to extend the review period until mid-March of next year, adding uncertainty to the ongoing situation.
Regarding future prospects, Eric Balchunas has been a leading voice in forecasting the SEC’s stance on spot Bitcoin ETFs. On August 30, Balchunas raised his probability of an area Bitcoin ETF approval this year from 65% to a more optimistic 75%. This renewed confidence stems from Grayscale’s lawsuit victory, a pivotal moment that undermines the SEC’s justification for denial.
As the judge’s unanimous rejection of the SEC’s arguments resonates throughout the industry, it is becoming evident that the regulator may struggle to justify further rejections as deadlines approach.
All eyes remain on this unfolding drama as Bitcoin navigates another twist in its journey through regulatory hurdles in the unpredictable cryptocurrency market, where fortunes can shift instantly.
