Ethereum co-founder Vitalik Buterin has expressed his endorsement for the Fork-Choice Enforced Inclusion Lists (FOCIL) upgrade, describing it as a vital enhancement of the network’s cypherpunk ideals.
This protocol modification, set to be a key feature of the Hegota hard fork in 2026, seeks to eliminate transaction censorship by requiring validators to incorporate all legitimate transactions into the blockchain.
In particular, FOCIL stipulates the inclusion of valid transactions to stop validators from filtering activities due to external sanctions or pressures. The upgrade collaborates with EIP-8141 to recognize smart accounts and privacy protocols as primary participants in the network.
Developers have planned for the mechanism to be part of the Hegota upgrade, aiming for a mainnet launch in the latter half of 2026.

In a recent post, Buterin remarked that FOCIL “enables censorship-resistant rapid inclusion” by employing 17 random participants per slot to curate transaction lists.

The technical specification mandates that if a proposed block neglects valid transactions from these lists, the chain will automatically fork away from it. This mechanism directly addresses criticisms regarding Vitalik’s broader perspectives on sovereignty, demonstrating a commitment to neutral, uncapturable infrastructure.
Industry analysts observe that this ensures any public-mempool transaction is settled within a defined timeframe.
The proposal indicates that smart wallet transactions, gas-sponsored transfers, and privacy protocol interactions will receive the same inclusion assurances as standard ETH transfers.

The intricacy of the Hegota upgrade has elicited varied responses from the developer community. While Layer 2 developer Tim Clancy deemed it crucial for neutral blockspace, others caution about possible conflicts with U.S. regulations if validators are compelled to handle sanctioned funds.
The market reaction has been cautious yet stable, with Ether maintaining its position at subdued levels as traders process the extended timeline.
Prior to Hegota, the network must successfully complete the Glamsterdam hard fork, which concentrates on Enshrined Proposer-Builder Separation (EPBS).
