Federal prosecutors disclosed that they expect to gather a significant amount of information from Terraform Labs founder Do Kwon’s communications as part of the evidence for his forthcoming trial, according to recent legal documents.

This comprehensive examination includes an analysis of Kwon’s email accounts, social media activity, and personal devices, forming an essential component of the discovery process.

According to a January 7 filing submitted to the Southern District of New York, the U.S. government intends to thoroughly investigate Kwon’s email accounts, Twitter activity, and personal devices.

The discovery process also encompasses Terraform’s marketing materials, internal business documents, and financial and trading records.

During Wednesday’s hearing, Inner City Press reported that prosecutors asserted they had discovered covert recordings of the incarcerated crypto founder, allegedly made without his consent.

The conference concluded with presiding Judge Paul A. Engelmayer scheduling Do Kwon’s highly anticipated trial for January 2026.

“Kwon’s constructed financial world was built on falsehoods and manipulative and deceptive tactics used to mislead investors, users, business partners, and government regulators regarding Terraform’s operations,” Tuesday’s filing states.

“Behind the scenes, core Terraform products did not function as Kwon promoted, and were manipulated to create the illusion of a viable and decentralized financial system to attract investors,” it continues.

Do Kwon’s Legal Issues Intensify Ahead of 2026 Trial

News of Kwon’s discovered communications comes just over a week after he was extradited from Montenegro to face charges in the United States following a lengthy battle with his home country of South Korea for his extradition.

Initially recognized for his algorithmic TerraUSD and LUNA, Kwon’s reputation plummeted after the coins’ dramatic collapse in May 2022.

The crash resulted in catastrophic losses for the global crypto community, with prosecutors claiming that his fraud wiped out over $40 billion from cryptocurrency markets.

Authorities pursued Do Kwon across Asia and Europe during a months-long manhunt after Interpol issued a “red notice” for his arrest.
