Twister Money Creator Alexey Pertsev Approved for Supervised Release from Custody

Alexey Pertsev, a developer associated with the cryptocurrency-mixing platform Twister Money, is set to be released from pretrial detention on Friday, January 10, 2025, under digital monitoring. He continues to challenge money laundering charges in the Netherlands.

His release precedes his appeal against a 64-month prison sentence that was imposed in May 2024.

Twister Money, a decentralized coin-mixing service, enables users to obscure Ethereum transactions by blending them with others.

Authorities have accused the service of facilitating illegal financial activities, including money laundering.

Twister Money Sanctions Overturned—Will This Assist Pertsev’s Appeal?

In a post on social media platform X, he confirmed his release, mentioning that returning home would provide him “an opportunity to work on my appeal and fight for justice.”

He noted that while digital monitoring does not equate to complete freedom, it is “better than jail.”

The decision by the Dutch court comes after months of unsuccessful bail requests from Pertsev and increasing scrutiny regarding the legal treatment of privacy-focused crypto developers.

His case has become a focal point in discussions surrounding financial privacy and the legal responsibilities of software developers.

Pertsev’s appeal gained traction following a ruling by a U.S. federal appeals court in November 2024, which deemed the sanctions against Twister Money unlawful.

This ruling bolstered arguments from privacy advocates who assert that developers should not be held accountable for the misuse of their code.

Ethereum co-founder Vitalik Buterin previously voiced concerns regarding Pertsev’s prosecution, describing it as a concerning precedent for developers.

At a conference in Berlin last year, Buterin stated, “The Alexey situation is definitely really unfortunate. I think a lot of people have been operating under the assumption […] that simply building software is something that’s okay and is a very legal and legitimate way to advocate for privacy.”

Additionally, Pertsev’s defense contends that he was merely developing open-source software and should not be held liable for its misuse.

Did Twister Money Facilitate Money Laundering? The Legal Battle Continues

The U.S. Treasury imposed sanctions on Twister Money in August 2022, claiming that the crypto-mixing service enabled the laundering of over $7 billion since its launch in 2019.

The sanctions primarily focused on its alleged involvement in laundering $455 million in stolen assets for North Korea’s Lazarus Group.

Following the sanctions, Dutch authorities apprehended Twister Money developer Alexey Pertsev in 2022, accusing him of facilitating illegal financial activities.

On May 14, 2024, Dutch judges at the ‘s-Hertogenbosch Court of Appeal found Pertsev guilty of money laundering.

He received a sentence of 5 years and 4 months in prison for allegedly laundering $1.2 billion through the platform. Pertsev has since announced intentions to appeal the verdict.

During his trial in March, Pertsev argued that he could not be held responsible for how users interacted with Twister Money.

However, the court dismissed this defense, stating that he and the other co-founders should have implemented stronger measures to prevent illicit activities.

In a surprising legal development, the U.S. District Court for the Western District of Texas has overturned OFAC’s sanctions against Twister Money.

According to a court filing dated January 21, 2025, the judgment has been reversed and sent back to the district court for further review.
