In a conversation on X, Marc Fagel – a former SEC Regional Director, contributed to the ongoing conflict between Ripple and the Commission. When discussing the likelihood of the request for an interlocutory appeal being approved, he stated:

Fagel also addressed the possibility of a settlement – a topic that has not been frequently mentioned in this discourse. When asked if the SEC would be open to a settlement prior to the trial to avoid testimonies from Hinman and Clayton, Fagel responded:
I think if the SEC is contemplating a settlement, it’s due to the high risk associated with the remaining claims against the individual. I don’t believe testimony from former SEC officials is a significant consideration.
