Potential Settlement Between Ripple (XRP) and SEC? Insights from Former SEC Director
The current case involving the United States Securities and Exchange Commission is one that the entire cryptocurrency sector is closely monitoring. However, it remains a divisive issue.
There appears to be no possibility for compromise, as it has consistently been a decisive matter. Nevertheless, one individual has raised the topic of a potential settlement.
In a conversation on X, Marc Fagel – a former SEC Regional Director, contributed to the ongoing conflict between Ripple and the Commission. When discussing the likelihood of the request for an interlocutory appeal being approved, he stated:
… the specific criteria for an interlocutory appeal are challenging to satisfy. I believe the chances of the request being granted are slim unless the court considers the points you mention.
The points under consideration include the significance of the case for the broader cryptocurrency sector, as well as whether there are any conflicting rulings at present. Fagel also addressed the possibility of a settlement – a topic that has not been frequently mentioned in this discourse. When asked if the SEC would be open to a settlement prior to the trial to avoid testimonies from Hinman and Clayton, Fagel responded:
I think if the SEC is contemplating a settlement, it’s due to the high risk associated with the remaining claims against the individual. I don’t believe testimony from former SEC officials is a significant consideration.
