Coinbase Challenges CFTC’s Prohibition on Event Contracts
Late Thursday, Coinbase’s Chief Legal Officer Paul Grewal openly contested the Commodity Futures Trading Commission’s (CFTC) suggested prohibition on event contracts.

“Event markets represent a promising sector of our future economy, which is why we are responding today to the @CFTC’s notice of proposed rulemaking,” Grewal stated in a post on X. “We fully endorse the CFTC’s mission to maintain the integrity of the US derivatives market and believe they can establish a strong regulatory framework for this emerging category of contracts. However, this proposal, if enacted, will unjustly prohibit numerous prediction contracts.”

In light of the federal agency’s decision to ban political wagers through event contracts this past May, Grewal has expressed concerns regarding the CFTC’s broad definition of gaming.
As per a May press release from the CFTC, the new proposal characterizes gaming as “staking or risking something of value on the outcome of a political contest, an awards contest, or a game in which one or more athletes compete.”
Grewal contends that this definition is not only “economically unsound,” but also “inconsistent with legislative history, muddles the relationship with established state regulations, and could result in adverse effects for emerging CFTC-regulated markets.”
“We urge the CFTC to retract this proposal and collaborate with academic, industry, and policy stakeholders to create a more equitable approach that fosters innovation while safeguarding the public interest,” the CLO of the crypto exchange stated.
U.S. Legislators Call on CFTC To Halt Political Wagers
Coinbase’s opposition to the ban arises just days after several prominent U.S. lawmakers, including Senator Elizabeth Warren (D-MA), sent a letter to CFTC Chairman Rostin Benham urging him to ban event contracts related to the outcomes of U.S. elections.
“Political wagers alter the motivations behind each vote, substituting political beliefs with financial considerations,” the lawmakers expressed. “Permitting billionaires to place substantial bets while concurrently contributing to a specific candidate or party, and allowing political insiders to gamble on elections using non-public information, will further undermine public confidence in the electoral process.”

Decentralized prediction markets have seemingly surged in recent months, with Polymarket, created by Shayne Coplan, offering several significant political bets, including whether Republican nominee Donald Trump or Democratic frontrunner Kamala Harris will secure victory in the 2024 U.S. presidential election.
A prohibition on election wagers proposed by the federal regulator would effectively restrict the types of event contracts that betting markets like Polymarket could permit in the future.
