Ripple's CTO addresses SEC appeal, emphasizes intricacies of the case

In a recent post on X (formerly Twitter), Ripple Labs’ chief technology officer, David Schwartz, highlighted a new development regarding the appeal from the United States Securities and Exchange Commission (SEC).

Schwartz noted that the SEC is pursuing an appeal at this juncture based on its belief that the legal case remains unresolved. This perspective allows the parties involved the opportunity to appeal after the case reaches its conclusion. This procedural approach aims to streamline the legal process and prevent ongoing interruptions to the primary case caused by numerous appeals related to minor rulings.

Following Judge Analisa Torres’ ruling on July 13, which determined that XRP (XRP) is not classified as a security when traded on digital asset exchanges, the SEC has filed an appeal. Although this action was triggered by the favorable ruling for Ripple, the SEC’s focus is on an unexpected development within the legal proceedings.

Schwartz emphasized that consolidating appeals is crucial for improving the situation, as separate appeals could prolong the legal process further.

Nevertheless, the executive clarified a guideline for exceptional circumstances. The SEC contends that the unique nature of this case warrants a different approach. It proposes pausing the process until the appeal is resolved, but Ripple opposes this suggestion.

Ripple asserts that even if the SEC is permitted to appeal, the primary lawsuit should continue while the appeal is underway. This aligns with the notion of allowing the trial to progress and addressing appeals thoroughly once all other matters are settled.
