The fifth largest cryptocurrency, XRP, has decreased by 8% in the past 24 hours, now trading at approximately $0.70. As per CMC data, the cryptocurrency is again positioned below Binance’s BNB. It currently holds the 5th spot on the list of top cryptocurrencies by market capitalization on CMC.

This decline follows a rise of over 80% after a favorable ruling in the Ripple v. SEC case prompted major U.S. exchanges like Coinbase and Bitstamp to relist XRP. Fox Business’ Charles Gasparino tweeted about the decline, referencing unresolved questions regarding the extent of Ripple’s victory in court as the cause.

Although it is a challenging reality, the pro-Ripple faction has largely overlooked the court’s decision that $700 million in XRP sales were deemed unlawful and must be refunded.

SEC Anticipated to Appeal

John Reed Stark, a legal analyst, has examined the court’s decision and identified several potential issues. Stark asserts that the ruling complicates the differentiation between private sales of XRP to accredited investors and sales of the tokens through programmatic methods on crypto exchanges.

Additionally, he argues that this approach may establish a new category of “quasi-securities” whose attributes differ based on the investor’s level of sophistication. Stark emphasizes that the ruling raises questions about whether token sales to experienced investors, such as venture capital firms, can be classified as securities.

The analyst concludes by stating that the SEC is likely to appeal the Ripple case to the 2nd Circuit and that the District Court’s conclusions regarding programmatic and other sales will likely be overturned.
