The government of Kyrgyzstan has submitted a draft law to parliament concerning the inheritance of funds held in electronic wallets. The central bank has proposed to exclude nearly all crypto assets from the scope of this legislation.

During the discussion of the initiative, Deputy Chairman of the National Bank Kanat Temirov informed lawmakers that the draft law would be amended to remove Bitcoin and other cryptocurrencies from the inheritance pool. According to Temirov, only assets in electronic wallets denominated in the national currency—soms—should be eligible for inheritance. 

If the central bank’s amendments are approved, the only asset that can be inherited will be the KGST token, which is backed by the Kyrgyz som and issued on the BNB Chain by state-controlled providers.

The draft law aims to equate electronic money with civil rights objects and include them as part of property—this provision is set to be added to the Civil Code. This change would allow for the inheritance of digital wallets and their contents alongside traditional bank accounts. In the absence of heirs, the government intends to transfer electronic funds to the state budget after a certain period.

Currently, there is a law in place that regulates the issuance and circulation of digital assets. Crypto assets are not transferable by inheritance. 

Over the past nine months, the volume of crypto transactions in Kyrgyzstan has exceeded $7.9 billion, and the total value of all digital asset operations for the year is projected to reach $20.5 billion, as reported in February by Temir Kazybaev, head of the republican Association of Virtual Asset Market Participants.

A company has been registered in the republic that issues a ruble-backed stablecoin, A7A5. This asset has facilitated the transfer of $100 billion over the year. The European Union has threatened sanctions against two Kyrgyz banks, which European officials accuse of providing cryptocurrency services to Russian companies that are under restrictions.
