In Russia, there is no mechanism for converting confiscated cryptocurrency into state revenue, which prevents these assets from being exchanged for rubles and allocated to the budget. This was stated by Madina Dolgieva, a senior prosecutor from the Main Criminal Court Department of the Prosecutor General’s Office, during a roundtable discussion at the Federation Council.
She reminded attendees that a law was signed in February recognizing digital currency as property and establishing procedures for its seizure and confiscation within the criminal process. However, according to her, these amendments do not fully address the issue. The legislation lacks a mechanism for the actual conversion of such property into state revenue. This implies that confiscated cryptocurrency cannot be exchanged for rubles and transferred to the budget, Dolgieva asserted.
The prosecutor provided an example: the first court ruling on the confiscation of cryptocurrency was issued in 2021, yet it remains unexecuted to this day. A similar situation is observed with subsequent rulings. Meanwhile, the value of cryptocurrencies has significantly increased during this period, and the state is formally the owner of substantial assets that it cannot liquidate.
Dolgieva attributed the current situation to the status of the Federal Bailiff Service (FSSP). According to the law on enforcement proceedings, this service is tasked with the storage, transfer, and liquidation of cryptocurrency. However, at present, the FSSP lacks the necessary tools to carry out these responsibilities, and it is not possible to exclude the service from the process. The specific tools required were not detailed by the prosecutor.
Dolgieva also noted that cryptocurrency has become a fundamental component of the criminal economy, and Bitcoin is no longer the most prevalent digital asset in illicit activities.
Previously, the governmental commission on legislative activity approved a draft law imposing criminal liability for organizing illegal transactions involving digital currency if it results in significant harm.
