The Energy Committee of the Russian State Duma has recommended the adoption of a draft law in its first reading, which establishes administrative penalties for illegal cryptocurrency mining.

For mining in regions where such activities are prohibited by authorities, it is proposed to impose fines on individuals ranging from 100,000 to 150,000 rubles, on officials and individual entrepreneurs from 300,000 to 800,000 rubles, and on legal entities from 1 million to 2 million rubles. A fine of 100,000–150,000 rubles is suggested for cases where an individual mines without being registered in the miners’ registry and exceeds the energy consumption limit (from 3,900 kWh to 6,000 kWh depending on the region).

Failure to provide the Federal Tax Service with information regarding mined digital currency and one’s cryptocurrency wallet (“identifier address”) may result in fines for individuals ranging from 100,000 to 200,000 rubles, for officials from 200,000 to 300,000 rubles, for individual entrepreneurs from 300,000 to 400,000 rubles, and for legal entities from 400,000 to 500,000 rubles.

For mining cryptocurrency without a license, officials are expected to face fines ranging from 200,000 to 300,000 rubles, individual entrepreneurs from 300,000 to 400,000 rubles, and companies from 400,000 to 500,000 rubles. Similar fines are set for operators of mining infrastructure if they lease equipment to companies lacking licenses. The same penalties apply for violations related to the submission of applications to the Federal Tax Service for inclusion in the miners’ or operators’ registry, as well as for providing inaccurate information.

The draft law also outlines an alternative penalty: officials may face disqualification for a period of one to two years, while individual entrepreneurs and legal entities may have their activities suspended for up to 90 days. In cases of repeated violations, it is proposed to increase the fines: for individuals from 1 million to 1.5 million rubles, for officials and individual entrepreneurs from 3 million to 5 million rubles, and for legal entities from 5 million to 10 million rubles.

Additionally, the Duma committee suggested adding a provision to the draft law concerning liability for violating the ban on mining or participating in mining pools in data centers that are included in a special registry maintained by the Ministry of Digital Development.

The draft law was introduced to the State Duma in January by a group of committee chairpersons: Nikolai Shulginov (Energy Committee), Vasily Piskarev (Committee on Security and Anti-Corruption), Anatoly Aksakov (Committee on Financial Markets), and Sergey Pakhomov (Committee on Construction and Housing and Utilities).
