New York Attorney General Suggests Legislation to Oversee Cryptocurrency Industry

Letitia James, the attorney general of New York, has put forward a bill aimed at regulating the cryptocurrency sector. This legislation will enhance the authority of the New York State Attorney General over local crypto firms.
The growth of the crypto sector in New York has been hindered by the state’s regulatory actions. New York is advancing additional regulatory initiatives to challenge the cryptocurrency sector, particularly following the implementation of the BitLicense requirement and a two-year moratorium on new licenses for proof-of-work crypto mining.
Excessive Regulation a Burden on Development
To further tighten oversight of crypto businesses in New York, Attorney General Letitia James has introduced the Crypto Regulation, Protection, Transparency, and Oversight Act (CRPTO). This measure will be presented for discussion in the New York State Senate and Assembly on June 8.
This legislation will grant the New York Attorney General’s Office greater authority in regulating crypto enterprises. Additionally, it formalizes the power of the New York State Department of Financial Services to issue crypto licenses and oversee the state’s digital asset licensing framework.
Moreover, the CRPTO Act mandates financial audits, refunds in instances of fraud, the safekeeping of client assets, and the lending or borrowing of customer funds for crypto exchanges and companies. In cases of non-compliance, subpoenas will be issued, and civil penalties of $10,000 per individual and $100,000 for each crypto business will be enforced.
Furthermore, regulation and oversight of the crypto market are essential. However, excessive regulation and burdensome requirements could impede the progress of this innovative sector. The crypto community has already expressed their dissatisfaction with New York’s BitLicense and mining prohibition.
